Warranty Disclaimer
Custom Built Headlights – All Out Industries, LLC warranties our custom built
headlights for a period of 1 year from the ship date. This warranty covers the
seal (for water intrusion) and paint (if optioned in such manner) - items that
we paint for pealing. HID components are warrantied for 3 years under
TheRetrofitSource. All Out Industries, LLC does not warranty the clearcoat on
any headlight lens, unless All Out Industries, LLC has performed such work on
your lights (reclearing the lens). All Out Industries, LLC does not warranty
labor charges on halos, parts are warrantied for 1 year through their
manufacturer. Labor rates vary by job and will be quoted if non warranty work
is to be performed. All Out Industries, LLC is not responsible for shipping (to
or from) for any warranty claims. Furthermore, All Out Industries, LLC cannot
be held responsible for damages obtained in shipping. All items shipped through
the shipping companies are not insured (unless otherwise requested), and if
damage occurs, All Out Industries, LLC will work with you on the claims process
with the shipping company. All Out Industries, LLC recommends professional
installation of all products we sell, and damage to lights due to improper
installation will not be covered under warranty. All other items on the site do
not carry a warranty (either expressed or implied), unless stated on their
product page. Any custom lighting builds or warranty repair work performed by All Out Industries, LLC that is not paid for in full by 60 days upon completion will become property of All Out Industries, LLC.
Limitation of Liability
All Out Industries, LLC shall not be liable for any special or consequential
damages that result from the use of, or the inability to use, the materials on
this site or the performance of the products, even if All Out Industries, LLC
has been advised of the possibility of such damages. Applicable law may not
allow the limitation of exclusion of liability or incidental or consequential
damages, so the above limitation or exclusion may not apply to you.
Typographical Errors
In the event that a All Out Industries, LLC product is mistakenly listed at an
incorrect price, All Out Industries, LLC reserves the right to refuse or cancel
any orders placed for product listed at the incorrect price. All Out
Industries, LLC reserves the right to refuse or cancel any such orders whether
or not the order has been confirmed and your credit card charged. If your
credit card has already been charged for the purchase and your order is
cancelled, All Out Industries, LLC shall issue a credit to your credit card
account in the amount of the incorrect price.
Term; Termination
These terms and conditions are applicable to you upon your accessing the site
and/or completing the registration or shopping process (including phone / email
orders). These terms and conditions, or any part of them, may be terminated by
All Out Industries, LLC without notice at any time, for any reason. The
provisions relating to Copyrights, Trademark, Disclaimer, Limitation of
Liability, Indemnification and Miscellaneous, shall survive any termination.
Notice
All Out Industries, LLC may deliver notice to you by means of e-mail, a general
notice on the site, or by other reliable method to the address you have
provided to All Out Industries, LLC.
DISCLAIMER
By entering your information for purchase and completing payment, the person that is purchasing this product makes the following representations, and acknowledges and agrees to the following terms and conditions:
This off-road race only product ("this Product") is designed and intend for use in organized, amateur and professional racing events, but is limited to closed-course racing and open-course racing that is formally sanctioned by a recognized racing organization involving the motor vehicle in which it is installed (the "Vehicle"). It is not for use on public highways or roads nor is it for recreational off-road use other than solely for competition purposes. The person or entity buying this Product and/or using this Product (the "User") agrees to use the Vehicle solely for competition uses as described herein.
The User signing this disclaimer acknowledges and hereby indemnifies and saves harmless All Out Industries, its officers, employees, agents, distributors and dealers for any damages, penalties, fines, expenses or other costs which may arise from the use of this product and without limiting the generality of the forgoing specifically acknowledges the following:
Use of this Product for purposes other than solely for competition is a violation of federal law and may violate applicable state or local environmental, motor vehicle and other laws. The User warrants that the product shall only be used in sanctioned closed-circuit events.
That use of this Product may violate warranties from the manufacturer of the Vehicle or from others.
That use of this Product may make the Vehicle unfit or unsafe for the purposes intended or for any purpose and cause personal injury, property damage or death.
That the installation of this Product, improper installation of this Product, use of this Product with other components or failure to use this Product in conjunction with other components, could result in or cause personal injury, property damage or death.
THIS PRODUCT IS FOR COMPETITION USE ONLY. ALL OTHER USES ARE CONTRARY TO FEDERAL LAW. IF YOU INTEND THIS PRODUCT FOR HIGHWAY OR NON-COMPETITION OFF-ROAD PURPOSES DO NOT PURCHASE OR INSTALL THIS PRODUCT.
Returns
We accept all item returns within 7 days of recieving the item. Products that are returned must be in like new, unused condition and are subject to a restocking fee of 20%. Customers are responisble for shipping costs back to us for retruns.
As with all custom work, there are some items that are not returnable.
Those items include (but are not limited to):
- Custom built headlights
- Custom built tail lights
- Painted emblems/badges
SHIPPING:
All Out Industries will not be held liable for packages that have been delivered to an address with incorrect shipping information that was provided from customer payment details. Customers are responsible for notifying us with any address changes or shipping details. All Out Industries will not be held liable for any packages that have been damaged in transit to or from by the shipping company. We ensure every package that is shipped from our facility to be properly packaged in order to prevent a damaged product from arriving.
Core Exchange & Refund Policy:
All cores that are used for build with our core exchange program are subject to minor wear and tear. We do our best to ensure we only keep headlights in great conditions with no broken/non working parts when they're sent out. Once cores are returned, they will be inspected to ensure that there are fully functional with no broken parts, have been tampered with or altered in anyway. All core charges will be refunded within 3-5 days of being receiving and inspected. All Out Industries LLC reserves the right to refuse any and all cores sent back if they're in less than usable condition, have been altered or have broken or missing parts.
